According to the complaint, the company has made significant profits by launching a separate, more expensive menu for those who cannot consume dairy.
The lawsuit claims that there is no significant difference between the prices of regular milk and non-dairy alternatives. The ten plaintiffs, who are either lactose intolerant or have a milk allergy, argue that the surcharge for dairy substitutes is a form of discrimination, violating the U.S. Food and Drug Administration’s laws.
